Terms and Conditions for the Annual Eduventures Summit

By checking the box, you confirm that you have read and agree to these Terms and Conditions (“Terms”) for your registration, attendance and participation this year’s annual Eduventures Summit (the “Summit”) understand that these Terms constitute a binding legal contract between you and Encoura, LLC (“Encoura”). If you are registering on behalf of another individual, it is your responsibility to ensure the person attending is aware of these Terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the attendee or participant aware of these Terms and that such individual(s) have accepted these Terms.

Cancellation/Refund Policy

Conference registrations are refundable only if submitted in writing to summit@encoura.org at least 30 days prior to the first day of the Summit (the “Deadline Date”).  Cancellation requests received after the Deadline Date are not refundable.  All determination of refunds will be at the sole discretion of Encoura.  You cannot reinstate a registration after you cancel it. If you cancel and are entitled to a refund, expect the refund within 20 business days. Registrations must be charged to a credit card or you may request an invoice by sending email to summit@encoura.org. All invoices must be paid prior to the first day of Summit, which is June 5, 2019. No purchase orders are accepted. All refunds will be issued back to the original payment type.

Please note: Registration cancellation will not automatically cancel your hotel reservation.

Substitution Policy

If you are unable to attend, you may send a substitute. Your substitute must first register themselves and pay the fee associated with their registration. Once this is complete, please send the substitute’s registration ID to the summit@encoura.org.  Once the substitute has been registered, your account will be cancelled and your fee refunded.  If the substitution takes place on-site, the substitute must bring a letter on company letterhead verifying the substitution.

Badge Pickup

Badges can be printed at any of the registration areas during the hours set forth on the website or as stated at the venue.  Encoura will not mail any badges in advance; all badges must be picked up onsite registration area.

Badge Misuse

If you are wearing badges from previous events or falsified badges and/or sharing or swapping badges with others, you will be immediately ejected from the Summit and may be banned from future Summits. Encoura considers such conduct theft of service, trespassing, and fraud and will report you to law enforcement authorities. If such conduct is discovered after a Summit, you will be invoiced according to onsite registration pricing and will be required to pay the invoice in full in order to avoid being reported to law enforcement authorities.

Registration Confirmation

Confirmations are auto generated and sent to the email address listed during the registration process. If you did not receive your confirmation, please contact summit@encoura.org.

Photography Disclaimer

From time to time, Encoura or its affiliates and contractors record (audio and/or video), photograph and/or stream the various aspects and activities of Summit, for various purposes, including, archival and promotional purposes.  By attending the Summit, you give Encoura and its affiliates and contractors permission to use your voice and image in any medium, including, archival or promotional recording, photograph or streaming activity without any compensation or credit to you.

Recording: Audio / Video / Streaming / Photography

By registering for Summit, you consent to this Audio / Video Policy. Photography and/or recording (including audio and video) during the Summit is allowed for personal and private use only, and such photos and/or recordings are the exclusive property of Encoura.  In addition, any such photos and/or recordings of Summit and exhibits in the Exhibit Halls may require the permission of the Exhibitor. Photos and/or recordings cannot be copied, altered, sold, exhibited or further distributed without Encoura prior written consent.  Encoura retains the right to revoke consent.  No disruptions due to photography and/or recording shall be allowed and violators may lose attendance privileges. Photography and/or recording are prohibited in Summit sessions. You also understand that you are prohibited from recording any educational session content unless you have obtained written permission in advance from Encoura, including the use of recording on social media feeds.

News Media Audio/Video Policy

If you are a news media and want to broad cast or otherwise cover the Summit, you must first request for media access and agree to media coverage policy.  For media access, please email summit@encoura.org for more information.

Right to Cancel/Reschedule

Encoura reserves the right to cancel or reschedule programs and to close registration when events, programs or other parts of the Summit are sold out. For these reasons, you are advised against purchasing any non-refundable reservations (hotels, airline, auto, etc.). Should the Summit be cancelled, your registration fee will not be refunded, but will automatically be applied to the next Summit.

Not to Distribute Attendee Roster

You agree not to copy or permit to be copied, in any form or format, without the express written permission of Ecnoura, any of the contents of the attendee roster. You also agree not to use the roster contents for any commercial, marketing, promotional, or political purposes. No solicitation is permitted by anyone except by exhibitors within the confinement of their booth.

Consent to Receive Emails, Correspondence and Other Promotional Materials; Data Collection

By registering, you are providing permission to receive emails and mailings related to Encoura.  If you wish to opt out of receiving any of these materials you may do so by emailing summit@encoura.org.  By registering for Summit, you consent to NAB’s collection and storage of the data on the registration form.

Appropriate Conduct

You are expected to behave responsibly and to treat each other – and treat the community, venue and others at the event – with respect, kindness, and compassion. Encoura reserves the right, without refund, to revoke the credentials of participants whose conduct is deemed inappropriate, disorderly, or offensive by Encoura, affiliated third parties or the local authorities.

Private Event

The Summit is a private event and has a weapons-free policy.  You are prohibited from carrying weapons of any kind, including concealed or displayed firearms. You are not permitted to bring weapons onto the premises of any official Encoura events. Encoura reserves the right, in its sole discretion, without refund, to deactivate and/or revoke the credentials of participants who violate this weapons-free policy. You agree that this policy is in force, and agrees to comply with the policy, regardless of whether signs prohibiting weapons are posted at the premises of any official Encoura event.

Information with Attendees

Encoura does not share your email address with exhibitors. If you receive email from an exhibitor, contact the exhibitor directly to remove your name from their distribution list. You may also alert Encoura at summit@encoura.org.

Intellectual Property

All intellectual property rights in and to the Summit, the Summit content, and all materials distributed at or in connection with the Summit are owned by Encoura, the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Summit, in any Summit content or in any materials distributed at or in connection with the Summit for any reason without the prior written permission of Encoura.  For the avoidance of doubt, nothing in these Terms and your attendance at the Summit shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by Encoura or any of its affiliates; nor do these Terms grant to you any right or license to any other intellectual property rights of Encoura or its affiliates, all of which shall at all times remain the exclusive property of Encoura and its affiliates.

LIMITATION OF LIABILITY

IN NO EVENT SHALL ENCOURA BE LIABLE TO YOU, ANY PARTICIPANT, OR ANY OTHER PERSON OR ENTITY FOR ANY PERSONAL INJURY OR DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF BUSINESS PROFITS OR OTHER PECUNIARY LOSS, INCLUDING ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES, ARISING OUT OF ANY PARTICIPANT’S USE OF THE REGISTRATION, CREDENTIALS AND/OR PARTICIPATION IN THE EVENTS AND THE SUMMIT, EVEN IF ENCOURA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THE MAXIMUM AGGREGATE LIABILITY OF ENCOURA FOR ANY CLAIM IN ANY WAY CONNECTED WITH, OR ARISING FROM THE EVENT, THE SUMMIT OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT, OR OTHERWISE (INCLUDING ANY NEGLIGENT ACT OR OMISSION), SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO ENCOURA UNDER THESE TERMS.

NO WARRANTY

EXCEPT AS MAY BE EXPRESSLY SET FORTH IN THESE TERMS, PARTICIPANT’S PARTICIPATION IN THE EVENTS, AND ALL SERVICES AND PRODUCTS PROVIDED IN CONNECTION WITH THE EVENTS, ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, AND NO OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, ARE MADE WITH RESPECT TO THE SAME, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR SAFETY, OR ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING. ENCOURA EXPRESSLY DISCLAIMS ANY WARRANTIES NOT EXPRESSLY STATED HEREIN.

INDEMNIFICATION

EACH PARTICIPANT, ATTENDEE, OR REGISTRANT, INCLUDING, BUT NOT LIMITED TO YOU (EACH, AN “INDEMNIFYING PARTY”) AGREES TO INDEMNIFY, DEFEND, AND HOLD ENCOURA AND ITS OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, SUPPLIERS, AND REPRESENTATIVES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS AND ALL OTHER LIABILITIES, INCLUDING, BUT NOT LIMITED TO , COSTS AND ATTORNEYS’ FEES, MADY BY ANY THIRD PARTY ARISING OUT OF THE OR IN CONNECTION WITH THE INDEMNIFYING PARTY’S USE OF THE REGISTRATION OR ATTENDANCE AT THE SUMMIT, OR ANY VIOLATION OF THE TERMS BY THE INDEMNIFYING PARTY.

Governing Law

These Terms will be governed by the laws of the State of Texas, without regard to its principles of conflicts of laws. You and Encoura hereby irrevocably submit to the exclusive jurisdiction of the United States federal and state courts located in Austin, Texas and agrees that any such court will be the proper forum for the determination of any dispute arising hereunder.

Right to Make Changes

Encoura reserves the right to make changes to these Terms at any time without notice to you, so please check back and review these Terms from time to time. In the event that any term or provision of these Terms shall be deemed invalid, illegal or unenforceable in any respect, such term or provision shall be deemed severable and shall not affect the validity and enforceability of any remaining term or provision.
